Reinvestment exemption in life annuities requires age of 65 or over

A person under 65 asks whether they can benefit from the reinvestment exemption after selling a property other than their primary residence. The DGT responds that being 65 years or older is an essential requirement to access this benefit.

The DGT's ruling

The exemption of capital gains from the transfer of assets requires the taxpayer to be over 65 years of age. The amount obtained must be allocated within six months to the establishment of an insured life annuity in their favor, subject to a limit of 240,000 euros. Furthermore, the requirements regarding periodicity, communication to the insurer, and limits on reversion mechanisms or reinsurance established in the Regulations must be met.
