Pensions from collective insurance deemed income from employment, no 30% reduction

The DGT states that payments from collective insurance for retirement are considered income from employment and are not eligible for the 30% reduction under Article 18 of the LIRPF.

The question raised

Tax treatment of the benefits.

The DGT's ruling

Collective insurance benefits that implement pension commitments are classified as employment income and are included in the general tax base to the extent that they exceed the premiums fiscally imputed to the employee and the contributions made by the employee themselves. These benefits are excluded from the 30% reduction provided for in Article 18 of the LIRPF. The transitional regime of the eleventh transitional provision could apply if the requirements regarding the date of contracting and the contingency are met.
