A zero-interest advance to an employee may constitute a species retribution

An employee asks whether receiving a salary advance without interest constitutes a species retribution. The DGT clarifies that if it is not an advance for work already performed, the difference between zero interest and the legal interest on money constitutes a species retribution.

The question raised

Existence of benefits in kind.

The DGT's ruling

Advances for work already performed that are reimbursed on the scheduled payment date do not constitute benefits in kind. However, an interest-free advance that does not fit this definition constitutes a benefit in kind from employment. Its valuation shall be the difference between the interest paid and the legal interest rate in force during the period.
