Current position
The exemption for reinvestment requires that the transferred property be a primary residence, which includes having been a residence for at least three years or at any time during the two years prior to the transfer. The newly acquired property must also meet the primary residence requirement. The reinvestment of the amount obtained must be carried out within a period of two years, either before or after the transfer, allowing for a proportional exemption if the total amount is not reinvested.
The DGT's position remains stable regarding the temporal and habituality requirements of the property. The two-year periods for the acquisition to be either prior or subsequent to the transfer have been specified. The criterion regarding the proportionality of the exemption when the reinvestment is partial has remained constant.
