Current position
The imputation of income depends on the nature of the income and the capacity to use the asset. Regarding real estate, income is not imputed if the property is under construction or unusable due to urban planning reasons, provided such situation is proven. For reductions based on net yields, these must be imputed in a single period and must not exceed 300,000 euros annually, excluding income from habitual economic activities.
The position of the DGT does not show a single doctrinal evolution, as the rulings address very diverse imputation scenarios (income from non-resident entities, real estate capital, insurance, and economic activities). There is no transversal change in criterion, but rather an application of current regulations to specific factual cases.
