No imputation of rental income for urban land pending construction

A landowner asks whether rental income should be recognised for urban land pending development. The DGT responds that no imputation is required in this case.

The question raised

Whether real estate income must be imputed for said land in the Personal Income Tax return.

The DGT's ruling

According to Article 85.1 of the Personal Income Tax Law (LIRPF), no income shall be imputed when dealing with properties under construction or when, for urban planning reasons, the property is not capable of use. As the land is a property pending construction, the imputation of real estate income is not applicable.
