How the DGT's position has evolved
Current position
For the exemption, the entity must not have the management of movable or immovable assets as its main activity, understanding economic activity as the organization of production means and human resources. The taxpayer must individually hold at least 5% of the capital or 20% together with their kinship group. Additionally, they must perform management functions and receive remuneration exceeding 50% of their total income.
The DGT's position remains constant regarding the requirements for minimum participation and remuneration for management functions. The requirement that the entity does not manage movable assets as its main activity has been maintained, specifying over time the nature of the economic activity and the allocation of assets.
