What is the finiquito in Spain?
The finiquito is the document that certifies the economic settlement of all outstanding amounts when an employment relationship ends in Spain, regardless of the reason: dismissal, resignation, contract expiry, or mutual agreement. It must not be confused with the indemnización por despido (unfair or objective dismissal compensation), which is an entirely separate concept and only applies in certain types of termination.
A standard finiquito covers three main components: the pro-rated salary for days worked in the final month, unused holiday pay (accrued at 2.5 days per month worked, with a statutory minimum of 30 calendar days per year under the Workers' Statute), and the proportional share of bonus payments (pagas extraordinarias) that have accrued but not yet been paid.
Your applicable collective bargaining agreement (convenio colectivo) may improve on these statutory minimums. BMC provides comprehensive employment law advice, including finiquito review, negotiation of exit terms, and wrongful dismissal claims. See our Employment Law service.
