What is a finiquito and what does it include?

The finiquito is the document that certifies the final economic settlement of all outstanding items when an employment relationship ends, regardless of the termination reason: dismissal, resignation, end of contract or mutual agreement. It should not be confused with severance pay, which is a separate entitlement that only applies in specific termination types.

The finiquito typically covers three items: the proportional salary for days worked in the termination month; outstanding vacation at the rate of 2.5 days per month worked (minimum 30 calendar days per year under the Workers Statute); and the proportional extra pay accrued but not yet received.

What is a finiquito in Spain?

A finiquito (final settlement) is the document that certifies the payment of all outstanding amounts when an employment relationship ends, regardless of the reason: dismissal, resignation, end of contract, or mutual agreement. It is distinct from severance pay (indemnización por despido), which only applies in certain types of termination.

What does the finiquito include?

The finiquito typically covers three items: (1) proportional salary for days worked in the month of termination; (2) accrued but untaken annual leave (vacation days) compensated at the daily gross rate; and (3) the proportional part of any outstanding extra pay (pagas extraordinarias) not yet received. The applicable collective agreement may provide for additional entitlements.

Is the finiquito gross or net?

The finiquito amount shown on this calculator is gross. It is subject to standard IRPF withholding and Social Security contributions under the general rules. Note that the finiquito does not include any severance pay for dismissal, which is calculated separately.

How is vacation compensation calculated in the finiquito?

Untaken vacation days are compensated at the daily gross rate: annual salary divided by 365, multiplied by the number of outstanding days. The Spanish Workers Statute (Art. 38 ET) and Supreme Court ruling of 8 June 2016 confirm this right applies regardless of the type of termination.

How are extra pay (paga extra) proportional amounts calculated?

The proportional extra pay depends on how many extra pays are set per year and how many months have elapsed since the last extra pay was collected. For example, if you receive 2 extra pays per year (every 6 months) and 3 months have elapsed since the last one, you are owed 50% of one extra pay. If extra pays are already spread across monthly salary (prorrateadas), the proportional amount is zero.

Can my employer refuse to pay the finiquito?

No. The finiquito is a legal obligation. If your employer refuses or the amounts are disputed, you may file a claim at SMAC (mediation) or directly with the labour tribunal (Juzgado de lo Social). By signing the finiquito with "no conformidad" (non-agreement) notation, you preserve your right to challenge the amounts.

Does the finiquito include severance pay?

No. Severance pay (indemnización por despido) is a separate entitlement only triggered by specific termination types (unfair dismissal: 33 days per year; objective dismissal: 20 days per year). Methodology and sources

This calculator applies the finiquito rules under the Spanish Workers Statute (RDL 2/2015). The calculation of proportional salary, accrued extra pay and vacation compensation follows Supreme Court case law. The result is indicative: collective agreements or individual arrangements may modify the amounts.

Proportional salary for the termination month
Calculated by dividing the monthly salary by 30 and multiplying by the days worked until termination.
Proportional extra pay
Calculated based on the number of extra pays per year and the months elapsed since the last extra pay was received. If extra pays are already spread across monthly salary, the proportional amount is zero.
Vacation compensation
Untaken vacation days generate a right to financial compensation at the gross daily rate. Article 38 ET and the Supreme Court ruling of 8 June 2016 confirm this applies on any type of termination.
