How the DGT's position has evolved
Current position
The 90% reduction requires that the contract be formalized in a stressed residential market zone and that the initial rent be more than 5% lower than the last rent of the previous contract, after applying the update clause. For the 70% reduction, the tenant must be an entity under Law 49/2002 intended for social rental or vulnerable persons. The 50% reduction requires that the property be used for housing and that the use falls to a specific natural person, which is a matter of fact.
The DGT's position remains constant in the interpretation of the requirements for the various reductions. Rulings have increasingly specified the calculation of the reference rent for the 90% reduction, clarifying that the update of the previous contract must be applied. Likewise, the factual nature of verifying the use of the housing for the 50% and 70% reductions has been reinforced.
