How the DGT's position has evolved
Current position
The delivery of land is subject to IVA (Value Added Tax) if the land is buildable, developed, urbanized, or undergoing urbanization. If the land is rustic and no material works of physical transformation have begun, the operation is exempt. In the case of land intended exclusively for parks, public gardens, or public use road surfaces, the delivery is considered subject but exempt.
The DGT's position has remained constant since 2014, focusing on the distinction between rustic land (exempt) and land undergoing urbanization or buildable land (subject). The most recent rulings have specified that the existence of urbanization costs incurred by the transferor is sufficient to consider the land as undergoing urbanization, shifting the criterion towards being subject to tax.
