Current position
The reduction for housing lease allows for the application of different percentages depending on the type of contract and lessee. The reduction is admitted when the lessee is a legal entity, provided that the exclusive use by natural persons for housing is proven. For specific percentage reductions, such as 90%, the formalization of new contracts in stressed areas with rents reduced compared to the previous contract is required.
The DGT's position has evolved from the application of the general reduction for young people to the incorporation of new scenarios linked to housing policy. Criteria have been added for non-profit entities and for contracts in stressed residential market areas. The doctrine maintains consistency in that the use of housing by legal entities is a matter of fact that must be proven.
