Current position

For the exemption due to reinvestment in the primary residence, the total amount obtained is calculated by reducing the transfer value by the principal of the loan outstanding at the time of the transfer. If external financing is used, the exemption applies proportionally to the amount actually reinvested relative to said total amount obtained. The period for reinvestment is two years, whether prior to or following the disposal.

The DGT's position remains constant in determining the amount obtained for the reinvestment exemption, always requiring the transfer value to be reduced by the outstanding principal. The rulings confirm that the exemption is proportional if the reinvestment is less than the total amount obtained. No doctrinal changes are observed, but rather a reiteration of the same calculation.
