Structural reinforcement deemed improvement, not repair expense

A property owners' association leases its roof for antennas and asks about the taxation of income and costs for reinforcing pillars. The DGT states that the income is rental income from immovable property and structural works constitute an improvement to the property.

The question raised

Question posed: Taxation of the aforementioned income and expenses in Personal Income Tax.

The DGT's ruling

Income from the lease of the rooftop is attributed to the co-owners according to their shareholding and is considered income from real estate capital. The works to reinforce structural pillars are classified as an improvement to the property, which implies an increase in the acquisition value. Therefore, they are not deductible as a repair expense, but must be deducted through the depreciation of the property in accordance with the regulations.
