Reinvestment exemption cannot be applied if the property is transferred more than two years after ceasing to be a primary residence

A taxpayer inquired whether they could apply the reinvestment exemption after selling a property that had ceased to be their primary residence more than two years ago due to a job relocation. The Directorate General for Taxes (DGT) ruled that this is not possible, as the transfer must occur within two years of the property losing its status as a primary residence.

The DGT's ruling

Para aplicar la exención, la vivienda transmitida debe ser la habitual en el momento de la venta o haberlo sido en cualquier día de los dos años anteriores. Una vez que se deja de residir efectivamente en la vivienda, el contribuyente dispone de un plazo de dos años para su venta sin perder el derecho a la exención. Si la transmisión se realiza fuera de ese plazo de dos años desde que dejó de ser habitual, no será de aplicación la exención por reinversión.
