Municipalities in financial risk: Ministry of Finance determines entities eligible to request adhesion to the Ordering Fund

This resolution complies with Royal Decree-Law 17/2014 to identify municipalities eligible to request adhesion to the 'Ordering Fund' compartment (art. 39.1.a). This fund aims to rectify the financial situation of municipalities at risk. Financial risk is defined, among other scenarios, when live debt as of December 31 of the previous fiscal year exceeds 110% of the current income liquidated or accrued (art. 39.1.a).

In 2 key points

  1. Financial risk if live debt exceeds 110% of settled or accrued current income (Art. 39.1.a) (art. 39.1.a)
  2. Requirement to comply with economic and financial information submission obligations (Art. 39.1.a) (art. 39.1.a)

How it affects those involved

For municipalities, the resolution sets the eligibility threshold for accessing financial aid mechanisms through the Management Fund. Town councils whose debt exceeds 110% of their current income and who comply with the submission of economic and financial information may apply for accession (Art. 39.1.a). The regulation also establishes a notification procedure to prevent the infringement of the legitimate rights and interests of those concerned (Art. 46 of Law 39/2015).
