Ministry of Culture: authorisation of the disposal of documentary series regarding competitive grants

The Undersecretariat of the Ministry of Culture has authorised the disposal of various documentary series of competitive grants that form part of the Documentary Heritage (Art. 48 Law 16/1985). The resolution applies technical assessment criteria to determine which files are to be fully disposed of, which are subject to partial disposal, and which require permanent preservation (opinions 37/2016 and 24/2017).

In 2 key points

  1. Full disposal of files after a period of 15/20 years for certain grants (e.g. training of Ibero-American professionals), opinions 37/2016 and 24/2017. (dictámenes 37/2016 y 24/2017)
  2. Permanent preservation of documentary series with historical value, such as aid for cultural development projects in Ibero-America, opinions 37/2016 and 24/2017. (dictámenes 37/2016 y 24/2017)

How it affects those involved

The resolution does not create direct obligations for grant beneficiaries, but rather regulates the internal archive management of the Ministry of Culture and its public bodies. For the public, this means that certain aid files (such as those for the training of Ibero-American professionals) may be disposed of after a period of 15 to 20 years, while others of a historical nature will be preserved permanently (opinions 37/2016 and 24/2017).
