Current position

In unit-linked insurance, the policyholder must assume the investment risk so that returns arising from the difference in net asset value are imputed. The payment of the premium through the delivery of listed shares is treated as a transfer of shares, generating capital gains or losses. If the policyholder's waiver constitutes a free transfer of their position to the beneficiaries, the benefits are taxed as income from movable capital in the savings tax base.

The DGT's position remains stable regarding the nature of the returns, but it has increasingly specified the tax classification of specific operations. The effects of the free transfer of the legal position and the nature of the share transfer in the payment of premiums have been defined. No change in criterion is observed, but rather an application of the rule to different operational scenarios.
