Companies must tax insurance compensation in the year it accrues
Determining the moment when a company must declare income from insurance compensation is a critical point for the correct settlement of Corporate Tax (Impuesto sobre Sociedades). Recently, the Dirección General de Tributos (DGT) has specified the rules for attributing this income in relation to accrual and the possibility of applying deferral criteria.
What the DGT has resolved
The administration has confirmed that the taxable base for Corporate Tax is constituted by the accounting result corrected through the relevant tax adjustments. In this sense, the compensation received for a loss must be attributed to the tax period in which it accrues.
The accrual criterion is met when the right to receive the compensation is practically certain or secure, regardless of the actual date on which the amounts are collected. Likewise, the ruling addresses the possibility of excluding from the taxable base the proportional part of the compensation that corresponds to depreciation not deducted in previous years. Regarding this, the DGT establishes that it is not possible to make such an exclusion at one's discretion to reduce the taxable base.
Regarding the attribution criterion based on collections, the regulations only allow its application in cases of installment operations. However, this criterion is not applicable if the period elapsed between accrual and the maturity of the final payment does not exceed one year.
What this means for you
For companies managing insured assets, this implies that receiving compensation generates an immediate tax obligation in the year in which the right to collection is certain. The declaration of income cannot be postponed based solely on cash flow or the date the funds are received.
Furthermore, companies may not use the residual tax value of an asset (acquisition value minus tax-deductible depreciation) to limit the amount of taxable income from compensation. The total amount of the compensation must be included in the taxable base, unless the strict requirements for installment operations are met.
What should be done
It is necessary for companies to analyze the certainty of the right to compensation at the time of the loss to determine the correct year for attribution. In the event that collection is fragmented into several payments, it must be verified whether the interval between accrual and the final collection is greater than twelve months to evaluate the application of the installment operations criterion in accordance with the Corporate Tax Law (Ley del Impuesto sobre Sociedades).
