Managers subletting holiday homes are not required to file Form 179

A query was raised regarding whether a manager who rents a property from an owner for a fixed fee and subsequently sublets it to tourists must submit the Form 179 informative tax return. The Directorate-General for Taxes (DGT) ruled that, as the sublessor is the ultimate provider of the use of the property, they do not act as an intermediary and are therefore exempt from this obligation.

The question raised

Cuestión planteada - El propietario arrienda su vivienda de uso turístico a un "Property Manager" o Gestor por un importe fijo mensual y éste la subarrienda a turistas por sus propios medios y a su propio riesgo. ¿Está obligado el Gestor a presentar la declaración informativa (modelo 179)?.

The DGT's ruling

La obligación de presentar el modelo 179 recae únicamente en los intermediarios que perciben una retribución por la consecución de la contratación entre cedente y cesionario. El gestor que subarrienda la vivienda actúa como cedente último del uso y no como intermediario, por lo que no tiene la obligación informativa. Por el contrario, las plataformas online que actúan como intermediarios mediando entre el gestor y el turista sí están obligadas a presentar dicha declaración.
