The tax base in the acquisition of real estate is its real value

The inquirer asks what value must be assigned to real estate for Transfer Tax. The DGT responds that the tax base is the real value of the asset and that the Administration may verify it through various means.

The DGT's ruling

The tax base in the acquisition of real estate consists of its real value. The value declared by the parties is not binding for the Administration, which may verify the real value through the means provided for in the General Tax Law. The declared value shall only be binding if the values published by the acting Administration itself have been used.
