If resident in Spain, income from Chinese airline pilot duties may be taxed in China and exempt in Spain

A pilot planning to reside in Spain has enquired about the taxation of income earned from a Chinese airline. The DGT clarifies that if they are a tax resident in Spain, they are liable for tax on their worldwide income; however, under the Double Taxation Convention, income from employment performed on board aircraft in international traffic may be taxed in the country where the company is headquartered (China).

The DGT's ruling

Si el piloto es residente fiscal en España, tributará por su renta mundial. Según el Convenio con China, las rentas por empleo a bordo de una aeronave en tráfico internacional pueden someterse a imposición en el Estado donde esté la sede de dirección efectiva de la empresa. En ese caso, estas rentas estarán exentas en España para evitar la doble imposición, aunque deberán incluirse para calcular el tipo medio de gravamen aplicable al resto de sus rentas.
