The obligation to file an income tax return depends on the actual ownership of rental income

A taxpayer asks whether they must file an income tax return after receiving €2,000 from the rental of a property of which they are a co-owner. The Directorate General for Taxes (DGT) responds that the obligation depends on whether their individual share of the income is less than €1,000.

Cuestión planteada Teniendo en cuenta que en 2014 el importe total de los ingresos del arrendamiento está alrededor de los 2.000 € y no teniendo ningún otro rendimiento, pregunta sobre la obligación de presentar la declaración del IRPF-2014.

The DGT's ruling

Los rendimientos del capital inmobiliario se atribuyen a quien ostente la titularidad dominical, independientemente de quién figure como titular registral. Si la titularidad corresponde a una comunidad de bienes, el contribuyente no está obligado a declarar si sus rentas íntegras como comunero son inferiores a 1.000 euros anuales. No obstante, si la titularidad del pro indiviso no está acreditada, la Administración puede considerar titular a quien figure en el registro, lo que podría generar la obligación de declarar si los ingresos superan los 1.000 euros.
