Back pay from court rulings is attributed to the year the judgment becomes final and subject to 15% withholding

The taxpayer inquires about the taxation of salary arrears received following a court ruling. The DGT determines that these must be attributed to the year in which the judgment becomes final and that a 15% withholding tax shall apply.

The DGT's ruling

Los rendimientos del trabajo pendientes de resolución judicial se imputan al período impositivo en que la resolución adquiera firmeza. Al percibirse en un ejercicio posterior al de su imputación, se debe presentar autoliquidación complementaria sin sanción ni intereses. No procede la reducción del 30% porque el período de generación no es superior a dos años. La retención aplicable es del 15% por tratarse de atrasos que corresponden a ejercicios anteriores.
