Acquisition value of inherited property determined by Inheritance Tax rules, not exceeding market value

A taxpayer inquired about the acquisition value to be used for an inherited estate following the submission of a supplementary Inheritance Tax return at a higher value. The DGT ruled that the acquisition value shall be determined by applying Inheritance Tax regulations, provided it does not exceed the market value.

The DGT's ruling

In transfers for consideration, the acquisition value is determined by the amount resulting from the application of the rules of the Inheritance and Gift Tax, provided that it does not exceed the market value. To this value, the expenses and taxes inherent to the acquisition must be added, excluding interest. The market value may be substantiated by means of evidence admitted in law.
