Property depreciation may be deducted by applying 3% to the higher of acquisition cost or cadastral value

A taxpayer inquired about the deductible depreciation expense for a rented, inherited porter's lodge. The Directorate General for Taxes (DGT) ruled that the deductible amount is 3% of the higher value between the acquisition cost and the cadastral value (excluding land).

The DGT's ruling

Para determinar el rendimiento neto del capital inmobiliario, es deducible la amortización del inmueble siempre que no exceda el 3% del mayor de dos valores: el coste de adquisición satisfecho o el valor catastral sin incluir el suelo. En el caso de bienes adquiridos por herencia, el coste de adquisición será el importe de los gastos y tributos satisfechos por la adquisición. Cada propietario determinará su amortización deducible en función de su coeficiente de propiedad.
