EU and EEA citizens: call for aptitude tests to practice law in Spain

The Directorate General for the Efficiency of the Public Justice Service has announced the aptitude tests required for lawyers from the European Union and the European Economic Area to practice their profession in Spain (Art. 1). This measure addresses the need to demonstrate knowledge of Spanish positive law as required by Royal Decree 581/2017 (Art. 22.3). Candidates who pass the tests must provide additional documentation within 15 working days (Art. 10).

In 2 key points

  1. Successful candidates must provide additional documentation within 15 working days (Art. 10). (art. Décimo)
  2. Documents issued by non-Spanish authorities require official translation into Spanish (Art. 10). (art. Décimo)

How it affects those involved

For EU and EEA lawyers, this resolution establishes the procedure for the recognition of their professional qualifications in Spain, making practice conditional upon passing the test and subsequent verification of requirements (Art. 22.3 RD 581/2017 and Art. 10). Successful candidates bear the responsibility of submitting official documentation translated into Spanish within a strict period of 15 working days to maintain the validity of their test results (Art. 10).
