Ministry of the Presidency, Justice and Relations with the Courts: approval of document series retention schedules

The Undersecretariat has approved the retention schedules for common and specific document series held by the Ministry of the Presidency, Justice and Relations with the Courts. This resolution establishes retention periods and access conditions for documents such as sentence redemption records or public employee payrolls, in compliance with Law 16/1985 on Spanish Historical Heritage (Art. 49.2).

In 3 key points

  1. Sentence redemption records (1939-1981): permanent retention and partially restricted access, Annex (Anexo)
  2. Public employee payrolls: total disposal after 6 years in peripheral services or after 80/100 years for those after 1940, Annex (Anexo)
  3. One-month period to lodge an administrative appeal (recurso de alzada) before the Minister, Art. 121 and 122 of Law 39/2015 (art. 121 y 122 de la Ley 39/2015)

How it affects those involved

For the Administration, the regulation defines criteria for the disposal and preservation of archives, preventing the destruction of documents with evidentiary value (Art. 55.2 of Law 16/1985). For citizens, it establishes the conditions for accessing historical or payroll documents, which may be partially restricted depending on their nature (Annex).
