Plant variety breeders: 10-year renewal of registration in the Register of Commercial Varieties

This Order provides for the renewal of the registration in the Register of Commercial Varieties for several varieties of different species (such as garlic, cotton, rice, tomato, among others) for a period of ten years (Art. 1). This measure is adopted in accordance with Article 22 of Law 30/2006, of 26 July, on Seeds, Nursery Plants, and Plant Genetic Resources, following requests from the breeders.

For the breeders of the varieties listed in the annex, the regulation guarantees the continuity of their commercial registration for the next decade, allowing the legal exploitation of said varieties (Art. 1). This resolution exhausts administrative remedies, meaning that only an appeal for reversal may be filed before the Minister within one month, or a contentious-administrative appeal before the National High Court within two months (Art. 1).
