Agricultural varieties: cancellation of registration for several varieties in the Commercial Varieties Register

The Ministry of Agriculture, Fisheries and Food has resolved to cancel the registration in the Commercial Varieties Register of multiple varieties across different species, including cotton, rice, maize, tomato, and wheat (Annex). This measure is adopted in accordance with Articles 51 and 52 of the General Regulation of the Commercial Varieties Register (Royal Decree 170/2011). This resolution exhausts administrative remedies, meaning only appeals for reversal or judicial reviews can be filed.

In 3 key points

  1. Cancellation of varieties of species such as cotton, rice, maize, tomato, wheat, and others detailed in the annex (Anexo)
  2. Entry into force on the day following its publication in the BOE (Orden APA/239/2026)
  3. One month period to file an appeal for reversal before the Minister (art. 114 Ley 39/2015)

How it affects those involved

For producers and companies in the agricultural sector marketing the varieties listed in the annex, this regulation results in the loss of official registration in the Commercial Varieties Register, affecting their legal status for marketing under those names. Affected parties have one month to file an appeal for reversal before the Minister or two months to file a contentious-administrative appeal before the National High Court (Art. 114 Law 39/2015).
