General State Administration: authorisation for the disposal of documentary series from various bodies

The Undersecretariat authorises the disposal or preservation of documentary series belonging to the Documentary Heritage of the General State Administration and its public bodies, as well as state documents held in Provincial Historical Archives (Art. 6 RD 1164/2002). The resolution establishes specific criteria for the disposal of documents such as title transfer forms (CU-6), income variations (CU-8), and public employee payrolls, conditioning the preservation of certain files to the Democratic Memory Law (Art. 26.2 Law 20/2022).

In 2 key points

  1. Total disposal of payrolls dated after 1940 after 80/100 years, except those protected by the Democratic Memory Law (44/2025)
  2. Total disposal of CU-6 and CU-8 forms after 10 years (43/2025)

How it affects those involved

For the Administration, the regulation allows for archive management and streamlining through the disposal of documentary series with defined retention periods (Art. 6 RD 1164/2002). For citizens and public employees, it establishes that the disposal of payrolls dated after 1940 is subject to the preservation of those covered by the Democratic Memory Law (Art. 26.2 Law 20/2022), thereby guaranteeing access to historical memory.
