Companies in Ibiza-Formentera remuneration scheme tender: may request cancellation of termination guarantees

The State Secretariat for Energy has declared the termination of the competitive bidding process for the additional remuneration scheme in the Ibiza-Formentera electricity subsystem due to the material impossibility of continuing it owing to unforeseen circumstances (Section Three). This resolution concludes the administrative route and allows interested parties to request the return of the guarantees provided for their applications.

In 3 key points

  1. Cancellation of guarantees permitted due to the material impossibility of continuing the procedure, Section Three (apartado Tercero)
  2. 2-month period to lodge a contentious-administrative appeal before the National High Court, art. 46.1 Law 29/1998 (art. 46.1 de la Ley 29/1998)
  3. 1-month period to lodge an appeal for reversal before the Ministry, art. 123.2 Law 39/2015 (art. 123.2 de la Ley 39/2015)

How it affects those involved

For companies that submitted applications (such as Endesa IB or Sampol Ingeniería y Obras SA), the resolution implies the cancellation of the process to obtain remuneration incentives in said area. Affected parties must carry out an administrative procedure to recover the financial guarantees deposited with the Directorate General for Energy Policy and Mines (Section Three).
