Elite athlete: exclusion from official status due to doping sanction

The Higher Sports Council (CSD) has resolved to exclude Davit Kevlishvili Marusashvili from the list of elite athletes of the Royal Spanish Judo Federation and D.A. This decision is based on the doping sanction imposed by the International Judo Federation (IJF) (Articles 15 and 16.2 of Royal Decree 971/2007).

In 3 key points

  1. Exclusion due to a doping sanction committed before the International Judo Federation (IJF) (art. 15 y 16.2 del Real Decreto 971/2007)
  2. One-month period to file an appeal for reversal with the CSD (art. 123 y 124 de la Ley 39/2015)
  3. Two-month period to file a contentious-administrative appeal before the National High Court (art. 11.1.a de la Ley 29/1998)

How it affects those involved

For the affected athlete, the resolution entails the immediate loss of elite athlete status due to the breach of IJF anti-doping rules (Article 20.2 of the IJF Anti-Doping Regulations). The affected party has one month to file an appeal for reversal with the CSD or two months to file a contentious-administrative appeal before the National High Court (Article 11.1.a of Law 29/1998).
