Ruling on appeal against negative Registrar's decision: suspension of registration due to neighbour's objections

The Directorate General for Legal Certainty and Public Faith has ruled on an appeal against a negative qualification note issued by the Land Registrar of Arteixo. The Registrar suspended the registration of the grouping of two estates and the declaration of new construction because a neighbour submitted objections within the proceedings under Article 199 of the Mortgage Law, claiming that the estate included a wall belonging to them (Facts II). The Registrar upheld the opposition and made the land registry conciliation procedure available (Legal Grounds II).

In 2 key points

  1. Suspension of the registration of estate grouping and new construction due to neighbour's objections (Hechos II)
  2. Possibility of using the land registry conciliation procedure under Art. 103 bis of the Mortgage Law (Fundamentos II)

How it affects those involved

For the owner of the estates (private individual), the registration of the grouping and the new construction remains suspended, preventing the registry consolidation of their property until the dispute with the neighbour is resolved (Facts II). The affected neighbour successfully halted the registration by submitting objections during the graphic base modification procedure (Facts II). The land registry conciliation procedure, provided for in Article 103 bis of the Mortgage Law, is enabled to resolve the conflict (Legal Grounds II).
