Properties under horizontal property regime: Homeowners' Association authorisation required to obtain rental registration number

The Directorate General for Legal Certainty and Public Faith has dismissed an appeal against the suspension of the assignment of a unique rental registration number (NRA) for a property under a horizontal property regime. The resolution confirms that, following the entry into force of the amendment to the Horizontal Property Act (Organic Law 1/2025), express authorisation from the Homeowners' Association is required to obtain said registration number.

In 2 key points

  1. Express authorisation from the Homeowners' Association is required to obtain the NRA for properties under a horizontal property regime (texto fuente)
  2. The obligation stems from the entry into force of the amendment to the Horizontal Property Act on 3 April 2025 (disposición final 1.ª de la Ley Orgánica 1/2025)

How it affects those involved

For owners of properties in buildings under a horizontal property regime wishing to carry out short-term rentals, obtaining the unique registration number (NRA) is subject to authorisation from the Homeowners' Association, due to the reform of the Horizontal Property Act in April 2025. This prevents the unilateral obtaining of licences via a responsible declaration if the property is constituted under this regime.
