Owners can request alternative georeferenced graphical representation after completing article 199.2 of the Mortgage Law

The October 8, 2025 Resolution allows property owners to request the registration of an alternative georeferenced graphical representation of a property after fulfilling the procedure in article 199.2 of the Mortgage Law, even in the presence of a neighbouring owner's objection. This mechanism ensures proper representation of the property in the Property Registry despite ownership disputes. The request is submitted via private application and processed at the Villacarriedo Property Registry (art. 199.2).

In 2 key points

  1. An alternative graphical representation can be registered following the procedure set out in article 199.2 of the Mortgage Law (art. 199.2)
  2. The request is submitted by private application and processed at the Property Registry of Villacarriedo (hechos i, ii)

How it affects those involved

Property owners of affected land can now request an alternative graphical representation even in the presence of a neighbour's objection, expanding their right to have up-to-date representations. Property registration authorities must manage these procedures with greater flexibility. Real estate advisors should inform their clients of this available legal route. Neighbouring property owners may face an increased risk of disputes due to the registration of alternative representations.
