Applicants may demand registration of cadastral graphic representation following rectification and neighbouring opposition

The Resolution of 31/03/2026 establishes that, following the descriptive rectification and new building extension procedure provided for in Article 199 of the Mortgage Law, and where opposition from a neighbouring owner occurs, the cadastral graphic representation may be registered (Art. 199). This change allows registration to take place once the procedure has been completed, even in the event of opposition, facilitating the update of cadastral descriptions for properties affected by new construction.

In 1 key point

  1. Registration of the cadastral graphic representation is permitted following rectification and neighbouring opposition (art. 199)

How it affects those involved

Owners and legal representatives of properties affected by new construction may demand the registration of the cadastral graphic representation once the rectification procedure has been completed, notwithstanding neighbouring opposition. Land registry administrations will be able to act with greater clarity in such cases. Property advisors should verify whether the rectification and new building extension procedure has been completed and whether opposition has been filed, in order to provide appropriate advice regarding the possibility of registration.
