Adjacent owners: 30-day period to object to georeferenced graphic representation registration

The resolution denies the registration of an alternative georeferenced graphic representation due to an objection from an adjacent owner, in accordance with Article 199.2 of the Mortgage Law. This mechanism allows neighbouring owners to prevent changes to a property's description within 30 days of the procedure's notification (Art. 199.2). This change strengthens the rights of adjacent owners against modifications to land descriptions.

In 2 key points

  1. Adjacent owners may object to the registration of georeferenced graphic representation within 30 days (art. 199.2)
  2. The objection is based on Article 199.2 of the Mortgage Law (art. 199.2)

How it affects those involved

Adjacent owners can now prevent modifications to a property's description within a 30-day period, protecting their property rights. Real estate companies and property managers must review graphic representation registration procedures to avoid objections. Notaries and registrars must notify neighbouring owners within the established timeframe. Advisors should inform their clients about the objection period and its consequences.
