Companies and lawyers: presentation entries cannot be requested with duplicate documents, photocopies, or private documents lacking title value

The Directorate General for Legal Certainty and Public Faith confirms the refusal of a presentation entry by a Land Registrar. It establishes that a new entry is not permissible if the title has already been submitted under a current entry (Art. II.1), that private documents do not satisfy the principle of legality as authentic titles, and that photocopies are not admitted as documents for submission to the registry (Art. II.1).

In 3 key points

  1. A new entry is not permissible if the title has already been submitted under a current entry (Art. II.1) (art. II.1)
  2. Private documents and photocopies are not admitted as titles to trigger a presentation entry (Art. II.1) (art. II.1)
  3. The refusal of a presentation entry may be appealed to the Directorate General for Legal Certainty and Public Faith (Art. 246.3 Mortgage Law) (art. 246.3 Ley Hipotecaria)
