30-day suspension of cadastral graphical representation upon adjacent titleholders' opposition

The Resolution of 27 January 2026 suspends the registration of cadastral graphical representation when adjacent titleholders oppose, as provided in Article 199 of the Mortgage Law. This mechanism activates after the submission of an inheritance deed and opposition from neighbours, as in the Carmona case. Suspension occurs upon opposition, as stipulated in Article 199 of the Mortgage Law.

In 2 key points

  1. Suspends the registration of the cadastral graphical representation upon objection by adjacent property owners (artículo 199 Ley Hipotecaria)
  2. The procedure is activated after submission of an inheritance deed and objection by neighbours (hechos I y II)

How it affects those involved

Adjacent property owners who file objections may suspend the registration of the cadastral graphical representation, affecting the evolution of immovable property records. Affected property owners lose progress on the correction of the property description. Registration authorities must act with greater care regarding objections. Legal advisors should monitor the status of objections in inheritance or property transfer procedures.
