Current position
The acquisition value of assets transferred gratuitously is determined by the value resulting from the Inheritance and Gift Tax (ISD) rules, without exceeding the market value. To this amount, the tax paid and the expenses or taxes inherent to the acquisition are added, excluding interest. In the case of real estate, investments and improvements that increase capacity or useful life are integrated into the value, whereas repair and maintenance expenses are not.
The DGT's position remains constant regarding the determination of the acquisition value for gratuitous transfers. Rulings have progressively specified the composition of said value, integrating the tax paid and distinguishing between improvements and maintenance expenses for real estate. No changes in criterion are observed, but rather an accumulation of technical clarifications.
