Current position

The delivery of urbanized land or land undergoing urbanization is subject to IVA (Value Added Tax) at the general rate of 21%. The exemption for rustic land is not applicable when the land is buildable, a plot, or has undergone physical transformation through infrastructure works. The urbanizing agent with the status of entrepreneur acts as the taxable person for the tax obligation.

The DGT's position remains constant regarding the application of IVA to urbanized land or land undergoing urbanization. Throughout the rulings, it has been reaffirmed that the satisfaction of physical transformation costs or the existence of administrative licenses strips the land of the rustic land exemption. No changes in criterion are observed, but rather a consolidation of the tax liability.

Turning points
