How the DGT's position has evolved

Doctrinal reversal High confidence 8 rulings · 2016–2026

Current position

The gratuitous contribution of separate property to a community property regime does not constitute a donation to the spouse, but rather an expansion of the community's assets. It is not subject to ITPAJD (Transfer Tax and Stamp Duty) on onerous transfers nor to Inheritance and Gift Tax (ISD), as the community property regime is not a taxable person for the latter. The operation generates a capital gain or loss in the contributor's IRPF (Personal Income Tax) for the portion that becomes common property.

The DGT's position has undergone a reversal regarding its initial criterion. While in 2016 and 2018 it was considered that gratuitous contributions were taxed under Inheritance and Gift Tax (ISD), as of 2023 the Directorate General establishes that there is no donation nor a taxable person for ISD. The current doctrine focuses on the nature of asset expansion and its effects on IRPF.

Turning points
