Taxpayers building their own home must complete construction within four years

Applying the reinvestment exemption for the construction of a primary residence requires strict compliance with time limits for both the investment of capital and the execution of the works. The Directorate General of Taxes (DGT) has specified the requirements necessary for individuals to avoid taxation on the capital gain derived from the sale of their primary residence when opting for self-build construction.

What the DGT has ruled

For the exemption to be effective, two conditions regarding timing and amount must occur simultaneously:

  • Reinvestment period: The entire amount obtained from the sale of the primary residence must be reinvested within a period of two years, either before or after the transfer of the sold home.
  • Completion period: The construction of the new home must be completed within a maximum period of four years from the start of the investment.

In self-build cases, the regulations establish that the acquisition date of the new home is understood to occur at the moment the works are completed. Likewise, the tax authority clarifies that any payment made outside the two-year period relative to the transfer date cannot be counted as a reinvested amount for the exemption.

What this means for you

If you have sold your primary residence with the aim of building a new one, it is not enough to simply allocate the money to the construction; you must control the execution timelines. If payments intended for construction are made outside the two-year margin from the sale, you will lose the right to the exemption on that portion of the capital. Furthermore, the calculation of the home's acquisition does not occur with the signing of the construction deed, but with the effective conclusion of the construction.

What you should do

It is necessary to maintain rigorous monitoring of the payment schedule and construction milestones. You must ensure that the total amount obtained from the sale is applied to the new construction within the two-year period and that the works are finished before four years have passed since the start of the investment. Given the complexity of these deadlines, it is fundamental to assess the particular situation of each construction project to avoid contingencies with the Tax Agency.
