Musical folklore workshops may be exempt from VAT if they meet cultural requirements

The nature of the activities carried out by cultural associations generates recurring doubts regarding their treatment in Value Added Tax (IVA). A recent binding ruling from the Directorate General of Taxes (DGT) analyzes whether providing musical folklore workshops for a fee must be taxed under this tax or if it can benefit from specific exemptions.

What the DGT has ruled

The tax authority's criteria establish that the provision of musical folklore workshop services is subject to VAT as long as the association providing them acts in the exercise of an economic activity as a business owner or professional. However, the body points out that these operations could be exempt under two scenarios provided for in Law 37/1992:

  • Exemption for education: according to article 20.one.9º, if the workshop has a strictly formative character.
  • Exemption for cultural services: according to article 20.one.14º, if the activity falls within cultural services.

To access these exemptions, the entity must meet the requirements of a private establishment of a social nature. Likewise, the DGT clarifies that if the entity's operations are exclusively exempt, it will not be obliged to submit periodic tax returns or the annual summary, although the obligation to issue an invoice will persist if the recipient of the service is a business owner or professional.
