Income from a finance lease with a purchase option is integrated according to accounting results

The tax treatment of finance lease contracts with a purchase option has raised doubts about whether monthly installments should be taxed as rental income or as payments on account of a future transfer. The Dirección General de Tributos (DGT) has specified the applicable criteria to determine the tax base for Corporate Income Tax (IS).

What the DGT has resolved

The tax authority establishes that, if a contract is classified accounting-wise as a finance lease, the entity must initially recognize a credit for the present value of the minimum payments plus the residual value. Consequently, the result derived from the operation, whether profit or loss, must be integrated into the tax base in the period in which it is accounting-wise recognized.

Furthermore, the ruling confirms that the financial income generated by the updating of said credit must be integrated in the periods in which it accrues, applying the effective interest rate method. This rules out the possibility of treating monthly installments simply as payments on account of the transfer price of the property from the beginning of the contract's term.

What it means for you

For companies operating with this type of contract, the key lies in the initial accounting classification of the operation. It is not possible to opt for a tax treatment based on receiving monthly installments as if they were common rental income, nor to treat it as a deferred sale from day one if the economic substance is a finance lease.

The integration into the Corporate Income Tax (IS) base will be strictly linked to the accrual of income and expenses according to current accounting regulations and the Corporate Income Tax Law (LIS).

What you should do

It is necessary to ensure that the accounting classification of the contract is correct from its formalization, as the schedule for income integration and the determination of profit or loss in each fiscal year depends on it. It is recommended to assess the structure of these contracts to ensure that the recognition of financial income and the result of the operation comply with the applicable tax regulations.
