The Dirección General de Tributos (DGT) has issued a relevant ruling regarding the tax nature of crypto-asset operations carried out by individuals. The inquiry focused on determining whether the buying and selling of cryptocurrencies with own funds can be considered an economic activity for Personal Income Tax (IRPF) and whether it entails the obligation to register for the Business Activities Tax (IAE).

The body has ruled that the buying and selling of cryptocurrencies carried out for oneself does not constitute an economic, business, or professional activity. This criterion holds regardless of the amount of the operations or the number of transactions carried out by the taxpayer.

The resolution bases its decision on the absence of an organizational structure. For an economic activity to exist, there must be an arrangement of production means and human resources destined for the production or distribution of goods and services. Since this element does not exist in the management of crypto-assets with own funds, the taxable event for the IAE is not met, and therefore taxation under this local tax is not applicable.
