Ownership-based crypto trading not considered economic activity

The consultant asks whether buying and swapping cryptocurrencies via automation constitutes economic activity for income tax purposes and whether registration in the IAE is required. The DGT responds that, when operating with own funds without providing services to third parties, there is no organisation of production means or human resources that qualifies the activity as economic.

The question raised

Whether the operations carried out constitute an economic activity within the scope of Personal Income Tax and whether registration in the Tax on Economic Activities is required.

The DGT's ruling

The purchase and sale of cryptocurrencies for one's own account, regardless of the amount or number of transactions, does not constitute an economic, business, or professional activity. As there is no organization of production means and human resources with the purpose of intervening in the production or distribution of goods or services, the taxable event for the IAE is not met. Therefore, taxation under this local tax is not applicable.
