VAT treatment on contributions from the Administration for school transport

The DGT states that public contributions are not price-linked subsidies or taxable consideration, and no invoice is required for such amounts.

The question raised

Question raised: Liability for Value Added Tax on the aforementioned school transport services provided by the applicant. Obligation to issue an invoice.

The DGT's ruling

Contributions from the Administration for school transport do not constitute subsidies linked to price nor consideration for transactions subject to VAT, as there is no significant distortion of competition. In non-compulsory school transport, the amounts paid by students are indeed consideration subject to VAT at the reduced rate of 10%. As the Administration's contributions are not taxable transactions, there is no obligation to issue an invoice to justify them, although other documents are required.
