Obligation to make progressive income tax payments if withholdings do not reach 70% of income

A professional with two business activities asks whether they must make progressive income tax (IRPF) payments when only 50% of their income is subject to withholding. The Directorate General for Tax (DGT) responds that quarterly payments must be made as the 70% withholding requirement is not met.

The DGT's ruling

Los profesionales no están obligados a efectuar pagos fraccionados si en el año anterior al menos el 70% de sus ingresos fueron objeto de retención. Al tener solo un 50% de ingresos retenidos, el contribuyente debe presentar el pago fraccionado trimestral. Para el cálculo del rendimiento neto se deben incluir todos los ingresos y gastos, independientemente de si han estado sometidos a retención o no.
